| RECOMMENDATION |
| It is recommended the Agency: |
| 1. Adopt Resolution No. 01-06 approving the Disadvantaged Business Enterprise (DBE) Program for the Shasta County Regional Transportation Planning Agency(RTPA), and |
| 2. Direct RTPA staff to prepare reports and documentation as needed to comply with state and federal requirements. |
| SUMMARY |
| Local agencies, including the RTPA, are required to adopt a DBE Program to receive federal funds. The adoption process includes a "Notice of Overall Goals" and a 45-day public comment period. The new program includes the latest state and federal requirements and must be adopted to receive federal funds for the current year. |
| DISCUSSION |
| In order to receive federal funds for planning, capital acquisition, engineering and construction costs for transportation projects, local agencies are required to adopt annual goals and programs to encourage DBE participation in federally funded contracts. Prior to adoption by local agencies and acceptance by Caltrans, local agencies are required to complete a Public Participation Process. The process includes a 45-day public comment period. During the 45-day review period no comments were received. |
| RTPA Goal Methodology |
| To establish Shasta County Regional Transportation Agency's Base Figure of the relative availability of DBEs in relation to all comparable firms available for Shasta County's contracting program. Shasta County Regional Transportation Agency has elected to utilize the Caltrans DBE Directory of Certified Firms (filtered to represent only DBE firms within Shasta County's relevant market area) for calculating the numerator and the Shasta Builders' Exchange (SBE) Summer 2001 Membership Directory (filtered to represent contractors which may perform professional services) within the same geographical market area to calculate the denominator, as follows: |
| For the numerator: Caltrans' DBE Directory of Firms in Shasta County |
| For the denominator: Shasta Builder's Exchange Directory of Firms in Shasta County |
| To derive at the relative availability of DBEs, the number of DBEs available in Caltrans' DBE directory was divided by the number of all comparable Shasta Builder's Exchange firms available. Application of this formula yielded the following baseline information: |

| The Base Figure resulting from this calculation is as follows: |
| Base Figure = DBEs *100 = 1 * 100 = 5.26% |

| The base figure is then adjusted using projected volumes of work DBEs are expected to perform, utilizing goals approved by other agencies and using the Census Bureau Business pattern database. The result of this adjustment is to raise the goal from 5.26% to 8.00%. |
| The proposed DBE goal for the Regional Transportation Planning Agency is 8 percent. This means that when the Agency contracts for professional services such as traffic model upgrades and air quality modeling activities, the contract would include DBE contractors that would do at least 8 percent of the work. |
| Staff is recommending that the Agency adopt the DBE program that includes the methodology and goal setting rationale. The DBE program adoption process is an annual process. This year's process is the same as last year's except for an optional public hearing which was held last year, because the DBE requirements were new and the RTPA wanted to maximize public input opportunities. A public hearing is not required for this process. |
| ALTERNATIVES |
| The Agency could choose to not to adopt the DBE program. This is not recommended because the Agency would become ineligible to receive federal funds. |
| OTHER AGENCY INVOLVEMENT |
| This project was supported by the TAC at their October 9 meeting. Caltrans also has an over site role for this process. |
| FINANCING |
| The adoption of an overall annual goal is required to receive federal funding for planning, capital acquisition, engineering and construction costs for transportation projects. Federal funds will be withheld from agencies who have not completed this process in accordance with the guidelines set forth by Caltrans and federal agencies. |
